Right to Be Safe vs Right to Take Risks for People Under Guardianship and Conservatorship and Supported Decision-Making

STAR is excited to welcome Anita Raymond, LISW, CMC as a guest speaker. Anita is an expert from the Center for Excellence in Supported Decision Making and she will be addressing the hot topic subjects of guardianship and rights.

​​How far do the responsibilities granted to a guardian or conservator extend into the daily lives of wards/protected persons? Conflict or confusion between persons and their guardians/conservators, and residential and care providers can quickly emerge as each entity may view the issues of right to self-determinization, the dignity of risk, and the need for protection very differently. This session will discuss these competing ethical values, provide practical and legal perspectives about self-determination and the right to take risks vs. the right to be safe conundrum.

At the conclusion of the presentation, participants will be able to:

  • List powers and duties of granted to guardians/conservators
  • Understand rights retained by persons under guardianship/conservatorship
  • Describe the tension between decision maker and provider needs for safety and quality of life and desires of the person served from legal, ethical, and practical perspectives.

In the afternoon, we will spend some time learning about the emerging and spreading practice of supported decision-making. We all ask people who we trust to help us wade through decisions. Some are small like, what do you recommend for lunch? To those with bigger consequences, such as I am thinking about moving or changing jobs, getting opinions and ideas from others before a decision is made is no different for those who use disability services. Supported decision-making is an approach to assisting people to have the information they need and want communicated to them in a manner they understand. Then they can make their own decisions in a way that mirrors how everyone makes decisions. Participants will be introduced to supported decision-making tools such as decision-making profiles and decision making agreements. Well thought out agreements can give the individual the positive control and choice they are seeking and address everyone’s concern for risk and safety.

Since 2014 the Administration for Community Living has funded efforts to offer an alternative to substitute decision-making, (power of attorney and guardianship being examples of just 2), to supported decision-making. This is consistent with efforts for increased self-determination as required by the Older Americans Act, Home and Community based Services regulations and the Olmstead Plan.
