WEBINAR - Benefits for European Migrants - Case law update

Thursday, 10 October '24   11am – 12:30pm BST

Details

This is a one-off, live, 90 minute webinar.

Overview
Eligibility rules for EEA nationals and family members who have not yet been granted settled status are particularly complex. The rules were intended to limit access to means-tested benefits to those applicants who have a ‘qualifying right to reside’. However, recent court decisions removed some of the restrictions allowing access to benefits to some applicants without a qualifying right to reside. This webinar looks at the most important case law developments and how we can challenge eligibility decisions.

Questions/topics covered
• What is the EU – UK Withdrawal Agreement and how does it affect eligibility?
• Who is within the scope of the Withdrawal Agreement?
• When can an applicant rely on the EU Charter of Fundamental Rights?
• New arguments - discrimination and ‘constitutive scheme’ case law update
