This session will be led by Tim Spencer-Lane, a lawyer who specialises in mental capacity, mental health and social care law.

This is a live briefing session, via Zoom, and you will be able to ask questions in real-time using the chat function on your screen. The session will NOT be recorded.

Tim will cover the following topics:

  • An update on the Government's decision to press ahead with the introduction of the Liberty Protection Safeguards (LPS) as the replacement for the Deprivation of Liberty Safeguards (DoLS)
  • What the courts have said recently about capacity to engage in sexual relations
  • Recent case law on mental capacity and eating disorders and medical treatment
  • Update on the Mental Health Bill and Terminally Ill Adults Bill
  • The Supreme Court reference case of October 2025 which is seeking to revisit Cheshire West
