Terms & Conditions

  1. Introduction
    1.1 We are ES Yoga Ltd. trading as “Emma Yoga”.

  2. Agreement to Terms
    2.1 By registering for and participating in the retreat (hereafter referred to as the "Retreat"), you (hereafter referred to as the "Participant") agree to be bound by these Terms and Conditions (hereafter referred to as the "Agreement"). The Retreat is organized and hosted by ES Yoga Ltd. (hereafter referred to as the "Host"). These Terms apply to both UK-based and international (outside the UK) retreats, including both day and multi-day retreats, unless otherwise specified.

  3. Important Warning
    3.1 Whilst on the retreat, don’t push yourself too hard in class. Always listen to your body and what it needs and stop if you are in pain.
    3.2 While we believe that our Retreat can be beneficial in many ways, it is not intended to diagnose, prevent, or treat any medical condition, to ascertain the state of your health, or to be used as a substitute for medical advice and we make no promise that the Service provides therapeutic benefit or that any particular “wellness” objective will be achieved. Please consult a health professional for advice on any injuries, conditions or illness.

  4. What this is all about – Introduction to our Terms and Conditions
    4.1 These are our Terms and Conditions which apply to our Retreat. We’ve tried to make them user-friendly. Please read them carefully and save a copy as we don’t file a copy specifically for the transaction with you. They’re available in English only.

  5. Registration and Payment
    5.1 For multi-day and international retreats, the required deposit or full payment is an offer to enter a legal contract with the Host. We accept your deposit and there is a binding legal contract.
    5.2. Payment: The full balance of the Retreat fee must be paid by the specified due date. Failure to make full payment by the due date may result in the cancellation of the Participant's registration without a refund of any deposits paid.
    5.3 The Participant agrees with the Host's specification of what is, and what is not included, in the Retreat cost. The Participant agrees to pay for any extras and items not included, in full, directly to the specific service provider when, and in the format requested.
    5.4 Full payment is due at booking for day Retreats and workshops unless otherwise specified.

  6. Eligibility
    6.1 Participants must be at least 18 years old (unless prior agreement has been made)

  7. Cancellation and Refunds
    7.1 Participant Cancellations: If the Participant wants to cancel the booking after the deposit, or full payment, the Host will fully reimburse the following:

80 days or more prior to the retreat – Your entire payment will be refunded, less the deposit.
• 79-43 days prior to the retreat: 50% of the retreat cost is refundable, less the deposit.
• 42 days or less prior to the retreat: Payments are not refundable nor transferable.
• In the event that the retreat has to be cancelled, a full refund will be given.

Should you need to cancel your booking for whatever reason, please contact us to discuss options. Should we be able to fill the place before the retreat, we will offer a full refund.

7.2 Host Cancellations: The Host reserves the right to cancel the Retreat due to insufficient registrations, natural disasters, or other unforeseen circumstances. In such cases, Participants will receive a full refund of all payments made to the Host. The Host is not responsible for any additional expenses incurred by Participants, such as airfare or travel costs.

  1. Transfers and Substitutions
    8.1 Participants may request to:
    • Transfer to a different Retreat (if available)
    • Substitute another person in their place
    This is subject to Host approval and may involve an admin fee. For international retreats, passport and travel documentation changes may be required.

  2. Passports, Visas, and Travel Documents (International Retreats Only)
    9.1 Participants are solely responsible for:
    • Ensuring their passport is valid for at least six months beyond the retreat end date
    • Obtaining all necessary visas or travel authorisations
    • Complying with any health or vaccination requirements for the destination country
    9.2 No refunds will be provided by the Host for failure to travel due to incomplete documentation or denied entry.

  3. Travel Insurance (Mandatory for International Retreats)
    10.1 Travel insurance is mandatory for all international retreats and is strongly recommended for UK-based retreats. Insurance should include:
    • Trip cancellation and interruption
    • Emergency medical care (including COVID-19 coverage if applicable)
    • Personal accident and personal liability
    • Loss of personal property
    • Travel delays and missed connections
    Proof of insurance may be requested prior to departure.

  4. International Travel & Transfers
    11.1. Group Transfers: For international retreats, group transfers to and from the airport/accommodation will be arranged by the Host and included in the Retreat package only for Participants who book the recommended flights or arrive/depart within a designated time window specified by the Host.
    11.2. Independent Travel Arrangements: If a Participant chooses not to book the recommended flights, or their travel falls outside the designated arrival/departure window, the Participant may be responsible for arranging and covering the cost of their own airport transfers.
    11.3. Transfer Discretion: The Host reserves the right, at its sole discretion, to decide whether to include or exclude airport transfers for Participants on different flight schedules. Any additional transfer support (e.g., private taxis or unscheduled pickups) is not guaranteed and, if provided, may incur additional charges payable by the Participant.
    11.4. Arrival Delays: Participants are responsible for ensuring their timely arrival. The Host is not responsible for any missed activities due to late arrivals or delays outside of the Host’s control, including those caused by flight disruptions.

  5. Health and Safety
    12.1 Medical Conditions: Participants must disclose any pre-existing medical conditions, allergies, or dietary restrictions at the time of registration (or within the forms emailed to participants prior to retreat). The Host reserves the right to decline participation if it deems the Retreat unsuitable for the Participant's health condition.
    12.2 Medical Assistance: The Host is not responsible for providing medical treatment or assistance. Participants are responsible for their own medical needs and must carry adequate medical insurance.
    12.3 The Host assumes no liability for medical or health-related incidents of a Participant during the Retreat.
    12.4 Participants agree to follow all local health regulations, including COVID-related guidelines, while abroad or in the UK.

  6. Participant Conduct
    13.1 Behaviour: Participants are expected to behave respectfully and courteously to other Participants, the Host, and third parties. Any behaviour deemed disruptive or harmful may result in the Participant being asked to leave the Retreat without a refund.
    13.2 Compliance: Participants must comply with all local laws and regulations, as well as any rules or guidelines provided by the Host.

  7. Liability
    14.1 Assumption of Risk: Participants acknowledge that they participate in the Retreat at their own risk. The Host is not liable for any injury, loss, or damage incurred during the Retreat, including travel to and from the Retreat.
    14.2 Participation in Retreat activities, including those abroad (such as yoga, hiking, swimming, excursions), involves inherent risks. By attending, Participants acknowledge and voluntarily accept these risks.
    14.3 The Host is not liable for:
    • Personal injury, illness, or death
    • Theft, loss, or damage of personal property
    • Travel disruptions or delays
    14.4 The Participant is fully responsible for the Retreat property; the furniture and all the accessories and objects found within it. The Participant is fully responsible to liaise and reimburse the retreat property If anything is damaged or broken by the Participant.
    14.5 Limitation of Liability: To the maximum extent permitted by law, the Host's liability for any claims arising out of this Agreement is limited to the amount paid by the Participant for the Retreat.

  8. Intellectual Property
    15.1 All materials provided by the Host during the Retreat, including but not limited to written materials, photographs, and videos, are the intellectual property of the Host and may not be reproduced or distributed without the Host's prior written consent.

  9. Force Majeure
    16.1 The Host is not liable for delays, disruptions, or cancellations due to events beyond reasonable control, including but not limited to:
    • Natural disasters
    • War, terrorism, or civil unrest
    • Strikes or governmental actions
    • Pandemics or health emergencies

  10. Use of Likeness
    17.1 Participants grant the Host permission to use photographs, videos, or other recordings taken during the Retreat for promotional and marketing purposes. Participants who do not wish to be photographed or recorded must inform the Host in writing before the Retreat.

  11. Governing Law
    18.1 This contract is under English law and any disputes will be decided only by the courts of the United Kingdom.

  12. Amendments
    19.1 The Host reserves the right to amend these Terms and Conditions at any time. Any amendments will be communicated to Participants in writing.

  13. Entire Agreement
    20.1 This Agreement constitutes the entire understanding between the Participant and the Host and supersedes all prior oral or written communications.

  14. Additional Terms and Conditions
    21.1 Nothing in this Agreement is intended to create or will be construed as creating a joint ventures, partnership, employer/employee or principal and agent relationship between users and the Company.
    21.2 If any court having competent jurisdiction holds any provision of these Terms of Service invalid or unenforceable in any respect, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of this Terms of Service shall continue in full force and effect.
    21.3 The failure or delay of either party to exercise or enforce any right or claim does not constitute a waiver of such right or claim and shall in no way affect that party’s right to later enforce or exercise it, unless such party issues an express written waiver, signed by a duly authorized representative.
    21.4 You may not assign these Terms of Service or any of your rights or obligations hereunder.
    21.5 Except as expressly specified herein, this Agreement shall create rights and obligations only between the Host and each individual user and it does not create any rights for any other parties.

  15. General but important stuff
    22.1 We may send all notices under this agreement by email to the most recent email address you have supplied to us. You can send notices to our email address shown. (emma@emmasilver.com). Headings used in this agreement are for information and not binding. If any part of this agreement is ineffective or unenforceable for any reason, the rest of the agreement shall continue to apply. If either of us overlooks any breach of this agreement by the other, it can still be actioned later. A person who is not a party to this agreement shall have no rights to enforce this agreement except insofar as stated otherwise. The parties are independent contractors and, except as otherwise specifically stated above, nothing in this agreement make any party as agent, employee or representative of the other.
